Hukuk Devletinde Direniş Hakkı Olarak Sivil İtaatsizlik
Abstract
Sivil itaatsizlik, adalet ve eşit haklar için mücadele eden yurttaşların, herkesin vicdanına hitap ettiği, şiddeti reddettiği ve iktidara yasaları adil bir şekilde uygulama çağrısı yaptığı eylemlerdir. Tarih boyunca farklı ülkelerden farklı yurttaşların başvurduğu bu eylem, günümüzde de geçerliliğini korumaktadır. Dolayısıyla bu çalışmada, bir direniş yöntemi olarak kullanılan sivil itaatsizliği, Hannah Arendt, John Rawls ve Jürgen Habermas'ın görüşlerinden yola çıkarak hukuk devletindeki rolü ve işlevi boyutuyla tartıştık. Öte yandan sivil itaatsizliği, günümüzde nasıl geliştiğini tartışmak için Plaza De Mayo Anneleri ve Belucistan'daki Baloch Yakjehti Committee (BYC) eylemlerinin üzerinde durduk.
Civil disobedience is an act of citizens fighting for justice and equal rights, appealing to the conscience of all, rejecting violence and calling on the government to enforce the law fairly. This action, which has been practiced by different citizens from different countries throughout history, is still valid today. Therefore, in this study, we have discussed civil disobedience as a method of resistance in terms of its role and function in the rule of law based on the views of Hannah Arendt, John Rawls and Jürgen Habermas. On the other hand, in order to discuss how civil disobedience has developed today, we have focused on the actions of Plaza De Mayo Mothers and Baloch Yakjehti Committee (BYC) in Balochistan.
