Abstract
Bu çalışma, İslâm ceza hukukunda adam öldürme, yaralama, hırsızlık ve zina suçlarında suç kastı hakkındadır.Tez, önsöz, giriş ve dört bölümden oluşmaktadır. Önsözde, çalışmanın konusu ve öneminden; giriş bölümünde, çalışmanın amacı, sınırları ve metodundan bahsedilmiştir.Birinci bölümde, suç ve ceza kavramları genel başlığı altında, suçun unsurları, ceza kavramının mahiyeti, İslâm hukukundaki ceza çeşitleri ve cezalandırmanın gayelerinden bahsedilmiştir.İkinci bölümde, kast nazariyesi genel başlığı altında, kastın anlamı, kast ile saik arasındaki fark, kasıtta aranan şartlar, kast çeşitleri ve kastın tespiti esaslarından bahsedilmiştir.Üçüncü bölümde, ceza özel hükümleri açısından kast genel başlığı altında, İslâm ceza hukuku ve günümüz ceza hukukunda öldürme, müessir fiil (yaralama), hırsızlık ve zina suçundaki kast unsurundan bahsedilmiştir.Dördüncü bölümde, kastın cezaya etkisi genel başlığı altında, öldürme, müessir fiil (yaralama), hırsızlık ve zina suçlarında kastın, cezaya etkisinden bahsedilmiştir.Son olarak ise, işlenen bölümlerin genel bir değerlendirilmesi yapılmıştır.
In the present study, the intention of crime in murder, injury, theft and adultery in Islamic criminal law was investigated.The thesis was consisted of preface, introduction and additional four parts. The topic and importance of the study were presented in the preface and the aim, framework and methodology were investigated in the introduction. In the first part, under the general heading of the concept of crime and penalty, the elements of crime, the essential character of penalty concept, the kinds and aims of penalty in Islamic criminal law were presented.In the second part, under the general heading of ?the intention theory?, the meaning of intention, the difference between the intention and motive in crime, the conditions considered in intention, the kinds of intention and the essentials for determining of intention in crime were talked about.In the third part, under the general heading of ?intention in terms of particular judgment of penalty?, the intention element in murder, injury, theft and adultery crimes in Islamic and contemporary criminal law was discussed.In the fourth part, under the general heading of ?the effect of intention on penalty?, the role of intention in punishment of murdery, injure, theft and adultery was discussed.As a conclusion, a general evaluation on the parts discussed was done.
