An Assesment on Cultural and Natural Heritage Protection Laws ( With the Directives and Regulations) of Turkey and Iran

Abstract

Bu çalışmanın amacı ülkemizde bulunan kültürel ve doğal varlıkların korunması ile ilgili yasal işleyişi sağlayan 2863 sayılı Kültür ve Tabiat Varlıklarını Koruma Kanunu ile İran Kültür ve Tabiat Varlıklarını Koruma Kanunu incelenmesi ve kanunun,yönetmelik ve yönergelerle karşılaştırılmasıdır. Bilindiği üzere Türkiye binlerce yıldır farklı medeniyetlere ev sahipliği yapmıştır. Yapılan çalışmalarda bize geçmişle, bu medeniyetlerle, sosyokültürel yaşamla ve daha pek çok konu ile ilgili son derece önemli bilgiler, materyaller kazandırmıştır. Tüm bu varlıklar Türkiye'nin dünya tarihindeki yeri ve önemini vurgulamakla birlikte Türk ve dünya tarihindeki yeri ve önemini pekiştirmiştir. Tüm bu kültür ve tabiat varlıklarını korunması Türkiye'de 1869 tarihli Asar-ı Atika Nizamnamesi ile başlamış ve günümüze gelene kadar pek çok aşamadan geçerek 1983 tarihli 2863 sayılı Kültür ve Tabiat Varlıklarını Koruma Kanunu ortaya çıkmıştır. İran'da geçmişi çok eskiye dayanan ve çok köklü imparatorluklara, medeniyetlere ev sahipliği yapmış ve dünyada tartışılmaz öneme sahip olan büyük ve kültürel zenginliğe sahip bir ülkedir. Tüm bu nedenlerle İran'da Türkiye gibi sahip olduğu bu kültür ve tabiat varlıklarının öneminin bilincinde olmuş, bu varlıkları koruma amacıyla İran Kültür ve Tabiat Varlıklarını Koruma Kanunu'nu oluşturmuştur. Bu çalışmada her iki ülkenin de Kültür ve Tabiat Varlıklarını Koruma Kanunu kanun, yönetmelik ve yönergeler ile incelenmiştir.

This study aims to review the Law on the Protection of Cultural and National Heritage No:2683, which forms the basis of legal functioning regarding the protection of cultural and natural heritage in Turkey, and the Law on the Protection of Cultural and National Heritage of Iran, and to compare there levant regulations and directives in these countries. Turkey is renowned for being home to different civilizations for thousands of years. The research activities that were carried out within the scope of this study provided us with valuable in formation and materials related to the history, these civilizations, socio-cultural life and many other subjects. Not only does this heritage highlight the impacts of Turkey in the history of the world but it also strengthensits importance and current position. The first law aiming to protect the cultural and natural heritage in Turkey is the Asar-ı Atika Code of Practice that dates back to 1869, which has evolved during the course of time and formed the basis of the Law on the Protection of Natural and Cultural Heritage No:2863 that came into effect in 1983. Iran is a country that has a very long history and it has been home to many great empires and civilizations, which makes it indisputably agreat and culturally rich country. For all the reasons, much the same as Turkey,Iran has been aware of the importance of its cultural and natural heritage and enacted the Law on the Protection of the Cultural and Natural Heritage. In this study, the laws of both countries on the Protection of the Cultural and Natural Heritage have been reviewed in the light of laws, regulations and directives.
