Abstract
Devletin malvarlığı içinde yer alan, kamu hizmetine ya da kamunun kullanımına tahsis edilmiş mallara kamu malları denir. Toplumun ortak gereksinimlerini karşılama noktasında kamu malları büyük paya ve öneme sahiptir. Devlet, genel ve ortak ihtiyaçlara kamu malı ve kamu hizmeti sunarak cevap verir ve bu sayede kamu yararı sağlar. Kamu yararının sağlanması için de plan, proje ve hukuksal düzenlemenin yanında finansmanı için kamu kaynaklarına ihtiyaç duyulur.Hazinenin mülkiyetinde bulunan taşınmaz mallarının mevcut durumlarının tespiti, kayıt altına alınması, korunması ve elden çıkarılması ile ilgili işlemler 5018 sayılı Kamu Mali Yönetimi ve Kontrol Kanunu ve 178 sayılı Kanun Hükmünde Kararname'ye göre Milli Emlak Genel Müdürlüğü'ne aittir.Hazine taşınmazlarının; kira, satış ve irtifak hakkı tesisi ile değerlendirilerek ülke ekonomisine orta ve uzun dönemde katkı sağlaması amaçlanmaktadır. Bu doğrultuda, atıl taşınmazların değerlendirilmesi ve uygun taşınmazların yatırımcılara devri gibi uygulamalarla, taşınmazlar üzerinden sağlanan gelir, sürekli arttırılmaktadır.Çalışmamızda mülkiyet kavramı, hazine taşınmazları ile kamu malının tanımı, türleri, nitelikleri açıklanmıştır. Hazine taşınmazlarının kazanılması, yönetimi ve elden çıkarılmasına ilişkin usul ve yöntemler ile günümüzde bu taşınmazların yatırım aracı olarak değerlendirilmesi, istatistikî veriler ışığında, eski ve yeni düzenlemeler mukayese edilerek anlatılmıştır.Yeterince büyük bir kara parçasına ve üzerinde de kalabalık bir nüfusa sahip olan ülkemizde, ulusal kalkınmayı sağlamak, bölgeler arası gelişmişlik farklarını asgari düzeye indirmek ve istihdamı artırmak için yatırımlar oldukça büyük öneme haizdir. Bu amaçla devlet belli zamanlarda belli sektörlere yönelik yatırım teşvikleri uygulamaktadır. Bu destekler, daha ziyade vergilerde uygulanan muafiyet ve istisnalar, faiz indirimleri, Sosyal Güvenlik Kurumu prim desteği ile kullanılmayan kamu taşınmazlarının bedelsiz ya da düşük bedelle girişimcilere sunulması olarak gerçekleşmektedir. Devletin asli vazifesi olan kamu hizmeti sunumunun yanında özel sektör için sağladığı bu destekler, Anayasamızda belirtilen ?sosyal devlet ilkesinin? bazı tezahürleridir.Çalışmanın son bölümünde ise, Van İlindeki taşınmazlar ile Hazine taşınmazlarının mevcut durumu, kullanımı ile 5084 sayılı Yasa'nın Van ilindeki uygulamaları anlatılmıştır. Konunun daha rahat anlaşılabilmesi için tablolardan yararlanılmıştır.
ABSTRACTGoods, which exist in the government assets and which are assigned to public service or public use, are called as public goods. Public goods have big share and importance in terms of meeting common needs of society. Government satisfies the general and common needs with serving public goods and public service and thus provides public benefit. In order to provide public benefit, besides the plan, project and legal arrangements, public sources are required for its financing.According to Public Finance Management and Control Law (5018) and Decree Law no. 178, Operations related with determination, recording, protecting and disposing of present situations of real properties belonging to Treasury are the responsibility of General Directorate of National Property.It is aimed that Treasury real properties contribute country economy in middle and long term via rent, sale and constitution of servitude. In this direction, income earned on properties are increased continuingly by applications such as utilizing inactive properties and transferring proper properties to investors.In this study, property concept, definitions, kinds and characters of treasury properties and public good are explained. In the light of statistical data, procedures and methods concerning earning, management and disposing of treasury properties and evaluation of these properties as investment vehicle at the present time are described by comparing old and new regularizations.In order to ensure national development, minimize disparities between the regions, and increase employment in Turkey which has big mainland and large population, investment is very crucial. For this purpose, government implements investment incentives to certain sectors at certain times. These supports generally occur as exemptions and exclusions applied in taxes, interest reductions, Social Security Institution premium support and giving unused public properties to entrepreneurs without charge or with low price. Beside presenting public service which is primary duty of government, these supports which are given to private sectors by government are the result of ?social state principle? indicated in the constitutional law.In the last part of the study, present situation and usage of properties in Van and Treasury properties and practices of Law no. 5084 in Van are explained. In order to present the subject clearly, tables are used.
