408 Numbered Court Register of Lice Transcription and Evaluation: of Islamic Calendar 1329-1331 of Gregorian Calendar 1911-1913

Abstract

Tezimizin konusu olan 408 Numaralı Lice Şer`iyye Sicili, Ankara Millî Kütüphane'de olup, Millî Kütüphane Arşivi'nde 408 Demirbaş Numarası ve 7109 Mikrofilm Numarası ile kayıtlıdır. Defter; H.1329-1331 / M.1911-1913 yılları arasındaki mahkeme kayıtlarını ihtiva etmektedir. Defter 140 sayfadan ve 202 hükümden ibarettir. Defterdeki ilk hüküm H. / 7 Zi'l-hicce 1329-29 Kasım 1911 tarihinde son hüküm ise H. 14 Rebî`ılevvel 1331 / M. 21 Şubat 1913 tarihlerinde verilmiştir. 408 Numaralı Lice Şer`iyye Sicili'nin tamamı eksiksiz olarak çevrilmiştir.Mahkemeye intikal etmiş davaları, şu başlıklar altında topladık: Alım-satım, borç ödeme, boşanma, kefâlet, mihir-nafaka, nikâh, verâset, vekâlet, vesâyet. Şer`iyye sicilleri bulundukları dönemin birinci dereceden kaynakları olması açısından bu çalışma, Lice'nin H.1329-1331 / M.1911-1913 yılları arasında sosyo-ekonomik yapısını ve hukukî uygulamalarını incelemek isteyen araştırmacılara, bu hususta birinci dereceden kaynak olan şer`iyye sicillerinin katkısını sağlamayı amaçlamaktadır.

Registry number 408 Lice Şer'iyye as my thesis subject is in Ankara National Library and registered as stock number 408 and microfilm number 7109 in National Library Archives. Registry subsumes court records between 1329-1331 Hegira / 1911-1913 AD. Registry consists of a hundred and forty pages and two hundred and two provisions. First provision in the registry was decided on the date of 7 Zi'l-hicce Hegira- 29 November 1911 AD and the last provision was decided on the date of 14 Rebi'ılevvel 1331 Hegira / 21 February 1913 AD. Registry number 408 Lice Şer'iyye was completely translated.We collected cases submitted to the court under these headings: purchase and sale, debt discharging, divorcement, bail, bridewealth- alimony, marriage, heredity, procuration, wardship. This study aims to contribute to the researchers who are willing to investigate the socio-economic structure and legal applications of Lice between the years of 1329-1331 Hegra / 1911-1913 AD regarding Şer'iyye Sicils (court registers) as the first degree sources of that era.
