The Judgments of War Country in Islami̇c Law

Abstract

'İslâm Hukukunda Dârülharp Ahkâmı' adındaki bu tezimiz bir giriş ve üç bölümden oluşmaktadır. Giriş bölümü araştırmanın konusu, amacı, önemi, yöntem ve sınırlılıklarından meydana gelmektedir. Araştırmamızın birinci bölümünde dârülharp ile ilgili konular kavramsal çerçevede ele alınmaktadır. Bu bölümde özellikle dârülharp kavramının Kur'ân ve Sünnet'teki yeri, ülkelerin dârülharp ve dârülislâm diye taksim edilmeleri ve dârülharp ahkâmının ortaya çıkış sebepleri delilleriyle ele alınmaktadır. İkinci bölümde mezheplerin dârülharp ile ilgili görüşlerine yer verilmektedir. Üçüncü bölümde 'İslâm Hukukunda Dârülharp Ahkâmı' ile ilgili en çok tartışma konusu olan hükümler, Kur'ân-ı Kerim, Sünnet ve Sahabe uygulamalarına dayandırılarak klasik ve çağdaş hukukçuların görüşleri çerçevesinde işlenmektedir. Bu bölümde İslâm âleminde en çok tartışma konusu olan dârülharpte faiz ve hadlerin uygulanması konusu üzerinde durulmaktadır. Ayrıca Cuma namazı, nikâh, ikamet, hicret gibi gündemde olan konulara da yer verilmektedir. Akabinde de bu konular ile ilgili Kur'ân-ı Kerim, Sünnet ve Sahabe uygulamalarından örnekler verilmektedir. Son olarak da klasik kaynaklarda yer alan bu kavramların zamanın siyasi şartlarından ne şekilde etkilendiğine değinilerek konu bitirilmektedir

Our thesis called 'The Judgments of Darulharp In Islamic Law' consists of an introduction part and three sections. The Introduction section consists of the subject, aim, importance, method and restriction of the research. In the first section of our research, the subjects, related to dârülharp are handled in a conceptual framework. We discussed the concept ''The Judgments of War'' are discussed in conceptual Way. We discussed that the concept of ''The Judgments of War Country's the place in Quran and Sunnah. It is discussed in that the countries are divided in two parts as war country and ıslam country and the reasons of the appearance of the 'The Judgments of War Country'. In the second section the ideas of the denomination about 'War Country' are discussed in detail. In the third section, some of the most discussed Judgments related to The Judgments of War Country' in islamic Law are discussed in detail according to sunna, Quran and appliciations of the compasions of prophet Muhammed with a framework the classical and contemporary lawyers. In this section, implementation of punishment and interest is amphasised in adobe of war. Also topical subjects such as to performing Friday prayer, marriage, residence, migration are some discussed. After ward, Quran, Sunna and implementation of companions of prophet Muhammed are given as examples about these subjects. Finaly, ıt is discussed how these concepts taking part in classical sources were effected from political events of the that time and the thesis is ended.
