Ottoman Empire in Years 1826-1839 Confiscation
Abstract
Müsadere: Kişinin mal varlığının çeşitli sebeplerle devlet tarafından el konulup hazineye aktarılmasıdır. Osmanlı Devleti?nde Fetret Devri esnasında Musa Çelebi tarafından başlayan müsadere, Fatih Sultan Mehmed Han devrinden itibaren devşirme kökenli devlet adamlarına uygulanmıştır. Osmanlı?da müsadere genellikle devlet adamlarının ölümü ya da görevden alınmasıyla başlamıştır. Sonraları ise müsaderenin alanı daha da genişletilmiş ve bazen yargılama bile yapılmadan beyana göre kişiler azledilip mallarına el konulmuştur. Özellikle araştırmamızda tedbir amaçlı ve ihanet edenlerin mallarının müsadere edildiğini görmekteyiz. Tezimizin asıl amacı 1826-1839 yılları arasındaki müsadereleri ortaya çıkarmaktır. 1826 yılında Osmanlı Devleti, Yeniçeri Ocağını kaldırdıktan sonra bunlara ait olan malları müsadere sistemiyle el koymuştur. Aynı zamanda yeniçerilere yakınlığı ile bilinen Bektaşi Tekkelerinin -Anadolu ve Rumeli?deki türbeleri hariç - bütün taşınır ve taşınmaz mal varlıklarına da yine bu usulle el konulduğu görülmüştür. 1838 yılında II. Mahmud, Ceza Muhakemesi Kanunu ile memurlara uygulanan bu sistemi kaldırdığını belirtmiştir. 1839 Tanzimat Fermanı ile müsaderenin tamamen kaldırıldığı belirtilmiştir. Confiscation: a person's assets are confiscated by the government for various reasons and transferred to the treasury. The confiscation, begun by Musa celebi During the Interregnum in the Ottoman Empire, was apllied to the recruited statesmen from the time of Fatih Sultan Mehmed Han. The confiscation started with the death or the dismissial of the statesmen. Later, confiscation area was more extended and the people were dismissed without trial and their prosperties were confiscated from time to time. In our study we see that the confiscation was carried out especially for the those having betrayed or the purpose of precaution. The main purpose of the thesis is to reveal seizures between 1826-1839. The Ottoman Empire in 1826, after removing the Janissary Corps, confiscated their the belonging by the system confiscation system. At the same time, Known for their proximity to the Janissaries, Bektashi tekkes' -except in Anatolia and Rumelia shrines - all movable and immovable assets were confiscated by this procedure. In 1838. II. Mahmud declared that he abolished this system applied to civil servants with the Criminal Procedure.
