Legal Regime and Audit of Dietary Supplements From Public Law Perspective
Abstract
Gıda takviyeleri, bir insanın beslenmesini desteklemek üzere kullanılan ve vitaminler, mineraller, amino asitler, bitkiler ya da bitkisel diyet bileşenleri gibi besin öğelerini içeren ürünler olarak tanımlanmaktadır. Başarılı pazarlama stratejileri, reklam ve internet kaynakları sayesinde takviye edici gıdaların kullanımı son yıllarda artmıştır. Dünyada ve Türkiye'de takviye edici gıdaya artan bir talep ve büyüyen bir pazar vardır. Öte yandan son zamanlarda, standartlara uymayan söz konusu ürünlerin neden olduğu yan etkilere bağlı olarak, zehirlenme ve hatta ölümle sonuçlanan olgulara dünyada ve Türkiye'de sıklıkla rastlanmaktadır. Bu nedenle, bu ürünlere ilişkin düzenlemeler giderek daha da önem kazanmaktadır. Takviye edici gıdalara ilişkin düzenleme yapma yetkisi ilgili mevzuat uyarınca Tarım ve Orman Bakanlığına verilmiştir. Ancak mevzuatta yer alan çakışmalar nedeniyle Sağlık Bakanlığı ile görev, yetki ve sorumluluklar konusunda sorunlar yaşanmaktadır. Çalışmamızda, yargı kararları ışığında mer'i mevzuatta takviye edici gıdalar için öngörülen düzenlemeler kamu hukuku açısından incelenmiştir..
Dietary supplement is defined as 'a product that is used by human to supplement the diet and contains dietary ingredients such as vitamins, minerals, amino acids, herbs or other botanical dietary substances'. Because of successful marketing strategies, advertising and internet information sources consumption of food supplements is increased in recent years. There is an increasing demand and a growing market for food supplements in the world and in Turkey. On the other hand direct intoxications related with these products as well as adverse effects due to non-standart products are observed recently in Turkey and World. Therefore, regulations regarding these products are becoming more and more important. The authority to make regulations regarding supplementary foods has been given to the Ministry of Agriculture and Forestry in accordance with the relevant legislation. However, due to conflicts in the legislation, there are problems with the Ministry of Health regarding duties, authorities and responsibilities. In this study, the regulations envisaged for food supplements in the current legislation in the light of the jurisprudences of courts were examined in terms of public law.
