The Opinios of Canon Law Sects on Tayammum and El-Cebre

Abstract

Namaz ibadeti konusunda tavizsiz bir tutum sergileyen İslâm dini bu ibadeti îfâ edebilme noktasında Müslümanlara bir takım ruhsatlar/kolaylıklar tanımaktadır. Bu ruhsatlardan bazıları da teyemmüm ve cebire meseleleri ile ilgilidir. Teyemmüm, suyu bulamayan veya bulup da bazı mazeretlerden dolayı kullanamayan kimsenin hades hâlini/hükmî kirliliği gidermek gâyesiyle ellerini toprak cinsinden temiz bir şeye sürerek yüzünü ve kollarını onunla meshetmesidir. Cebîre ise, vücudunun herhangi bir yerindeki kırık-çıkık vb. bir yaradan ötürü sargı bulunduran insanın abdest veya gusül sırasında bu sargıyı çözmeden üzerini meshetmekle yetinebilmesidir. Bu iki meselenin meşrûiyyeti kitap, sünnet ve icmâ ile sâbittir. Cumhur-u fukaha bu delillerden yola çıkarak teyemmüm ve cebîrenin meşrûyyetini ve ruhsat oluşlarını kabul etmektedir. Bu iki konunun detaylarında genel mânada birbirine yakın tutumlar sergilemekle beraber mezheplerin ihtilafa düştükleri bazı noktalar da vardır. Bu araştırmada dört büyük mezhebe göre teyemmüm ve cebîrenin tanımları, meşrûiyyetleri, hükümleri, teyemmümün yapılabildiği maddeler, teyemmüm ile cebîrenin farz, sünnet, mendup ve mekruhları, hem abdest almaktan hem de teyemmüm yapmaktan mahrum olan kişinin namazı ve teyemmümlü kimsenin imameti gibi durumlar ele alınmış, teyemmüm ve cebîre ile edâ edilebilen ibadetler ve bu ibadetlerin nihai durumları açıklanmış, dört mezhebin bu konularla ilgili ittifak ettikleri ve ihtilafa düştükleri noktalara dikkat çekilmiştir.

The Islamic religion, which has an uncompromising attitude about prayer, offers a number of licenses to the Muslims in the sense that they can practice this worship.. Some of these licenses are tayammum and cebire issues. Tayammum, is cleansing by rubbing one's hands, face and arms with pure soil with the aim of getting rid of impurity and judgemental impurity when water can not be in the reach or cant be used due to some excuses.. cebire, is making do with just rubbing the surface of a wrapping during ablution or gusul due to health issues such as fractures, dislocations, wounds, etc. The legitimacy of these two issues is established with the book, circumcision and icma. The four major sectarian scholars have accepted the legitimacy of tayammum and cebire depending on these arguments. The sects show close attitudes in the details of these two subjects in general terms and there are some points in which they are in conflict. In this study, the defitinitions of tayammum and cebire,their legitimacies,rules, the conditions in which tayammum can be performed, the fard,traditons,mandub and makruhs of tayammum and cebire are all gone through exclusively and in detailed comparison according to four major sects ,along with the eventual situation of prayers which can be performed through tayammum and cebire, moreover the approaches of some scholars which may result in difficulty in cebire and tayammum issues in spite of their being allowed are being mentioned.
