Comparative Analysis of the Presidential Government System and the Executive Bodies in the Us Presidential System

Abstract

Bir devlet içerisindeki kuvvetlerin genel dağılımını düzenleyen kurallar, hükümet sistemleri ile belirlenmektedir. Bu sebeple hükümet sistemleri, bir ülkenin devlet politikasında her daim önem arz etmektedir. Türkiye, 2018 yılında adına Cumhurbaşkanlığı hükümet sistemi denilen yeni bir hükümet sistemine geçmiştir. Cumhurbaşkanlığı hükümet sistemi, başta başkanlık sistemi ile eşdeğer olarak kabul edildiyse de sonradan iki sistem arasında temel farklılıkların olduğu gözlemlenmiştir. Bu çalışmanın amacı, Türkiye'de uzun süre tartışılan parlamenter sistemin 16 Nisan 2017 yılında yapılan referandum ile kabul edilen ve 9 Temmuz 2018 yılı itibari ile uygulanmaya başlayan Cumhurbaşkanlığı hükümet sistemine geçişle birlikte son bulması ve yeni sistemin yürütme bakımından incelenmesidir. Cumhurbaşkanlığı hükümet sistemi uzun süreli bir başkanlık sistemine geçiş çabalarının ürünü olarak karşımıza çıkmaktadır. Bu bağlamda tam olarak başkanlık sisteminin özelliklerini taşımamaktadır. Çalışma başkanlık sistemi ve cumhurbaşkanlığı hükümet sistemini yürütme erki üzerinden karşılaştırmalı bir şekilde analiz etmektedir. Türk tipi başkanlık sistemi veya cumhurbaşkanlığı hükümet sistemi olarak kabul edilen sistemin ABD'de uygulanmakta olan başkanlık sistemi ile ilişiği yürütme erki üzerinden tartışılmıştır.

The rules governing the general distribution of forces within a state are determined by the systems of government. For this reason, government systems are always important in a country's state policy. Turkey switched to a new government system called the Presidential government system in 2018. Although the presidential system of government was initially considered to be equivalent to the presidential system, it was later observed that there were fundamental differences between the two systems. The aim of this study is to end the parliamentary system, which has been discussed for a long time in Turkey, with the transition to the presidential government system, which was accepted with the referendum on april 16, 2017 and started to be implemented as of july 9, 2018, and to examine the new system in terms of execution. The presidential government system emerges as the product of efforts to transition to a long – term presidential system. İn this context, it does not fully carry the characteristics of the presidential system. The study analyzes the presidential system and the presidential government system in a comparative way over the executive power. The relationship between the Turkish type presidential system or the presidential system of government, which is considered to be the presidential system in the USA, has been discussed over the executive power.
