Fighting Substance Addiction: Corporate and Legal Methods

Abstract

İnsanoğlunun varoluşundan bu yana yaşamın devam ettiği her yerde sorun ve sıkıntıların varlığından bahsedilebilir. İnsanlar yalnızca kendi içinde değil iç içe etkileşim halinde yaşamlarını sürdürmektedirler. Bu nedenle yaşanılan ve yaşatılan sorunların çözümü bazen daha büyük sorunları ortaya çıkaracak çözümlere insanları yönlendirebilmektedir. Bağımlılık ve bağımlılığın ortaya çıkardığı sonuçlar sadece kişilere değil; çevresine, ailesine, içinde bulunduğu topluma, devlete ve hatta dünyaya yönelik büyük ve kaçınılmaz sorunlara yol açabilmektedir. Böylesi bir sorun ve tehdit için yalnızca bireysel bir mücadele sorunun çözümünü sağlayamamaktadır. Bu nedenle madde bağımlılığıyla mücadele için hem hukuksal hem de kurumsal mücadele yürütülmesi ihtiyacı ortaya çıkmıştır. Kurum ve kuruluşlar, vakıf ve dernekler ile yasama, yürütme ve yargı organları bir bütün olarak madde bağımlılığı ile mücadele etme ve bu sorunun ortaya çıkardığı sonuçlara karşı reaksiyonlar gerçekleştirmektedir. Madde bağımlılığını önleme ve buna sebep olan sorunların ortaya çıkarılması ve bu çerçevede çözümler bulunması hem madde bağımlılığının önlenmesini hem de bağımlığa sebep olan sorunların azalmasını sağlayacaktır. Böylesi bir sorunla mücadele yürütülmesine rağmen yetersiz kalma durumunun oluşması mücadele esaslarında ve yöntemlerinde ciddi revizyonların yapılması ihtiyacını ortaya çıkarmaktadır. Bu çalışmanın amacı madde bağımlılığıyla mücadele kurumların yürüttükleri çalışmaları ve hukuksal çerçevede yaptırımları ortaya çıkararak yol ve yöntemler belirlenecektir. Kurumsal yöntemlerin bazı yetersiz yanları ile birlikte madde bağımlılığıyla mücadelede daha da etkili hale getirilmesi gerekmektedir. Addiction and its consequences are not only for people; It can cause major and inevitable problems for its environment, family, society, state and even the world.Only an individual struggle for such a problem and threat cannot provide a solution to the problem. For this reason, the need for both legal and institutional struggle to combat drug addiction has emerged.. Institutions and organizations, foundations and associations, and legislative, executive and judicial organs as a whole react to against drug abuse and the consequences of this problem. Preventing drug addiction and revealing the problems that cause it and finding solutions within this scope will both prevent drug addiction and reduce the problems and consequences caused by addiction. Despite the struggle against such a problem, the emergence of the situation of inadequacy reveals the need for serious revisions in the principles and methods of struggle. The aim of this study will be to determine the ways and methods by revealing the works carried out by the institutions fighting against substance addiction and the sanctions in the legal framework. Institutional methods need to be made more effective in the fight against substance addiction, along with some of their inadequacies.
