Women's Fiqh in the Narrations of Hazrat Aisha

Abstract

Bu çalışmada Hz. Âişe'nin kadın fıkhına yönelik başlıca rivayetlerini belli bir çerçeve özelinde bir araya getirmeyi ve kadınlara ilişkin rivayetlerindeki fıkıh anlayışını tespit etmeyi amaçladık. Bu bağlamda hedefimiz Hz. Âişe'nin kadın fıkhını bizzat bir kadın olarak nasıl anlayıp yorumladığını, bu rivayetlerin mezheplerin görüşlerine nasıl ve ne ölçüde yansıdığını ortaya koymaktır. Bu yönüyle çalışmanın özgün bir muhtevaya sahip olduğuna ve bu husustaki boşluğun doldurulmasına katkı yapacağına inanıyoruz. Çalışmamızda öncelikle söz konusu rivayetler verildikten sonra Hz. Âişe'nin bu rivayetlere ilişkin yorumları aktarılmakta, mezheplerin bu rivayetler bağlamında ortaya koydukları görüşlere değinilmekte ve bu rivayetlerin mezheplerin kadın fıkhına dair görüşlerinin şekillenmesindeki etkisi ortaya konulmaktadır. Hz. Âişe'den gelen rivayetlerin kadın fıkhına kaynaklık ettiği, kadına yönelik olumsuz algıyı yok ettiği ve birçok konunun izaha kavuşmasına olanak sağladığı, rivayetlerin bizlere ulaşmamış olması halinde ise hükümlerde noksanlıkların oluşacağı görülmektedir.

In this study, we aimed to bring together the main narrations of Hazrat Aisha (may God be pleased) on women's jurisprudence (fiqh) within a certain framework, and to define her understanding of fiqh in her narrations about women. In this context, our goal is to reveal how Hazrat Aisha understood and interpreted the female fiqh as a woman herself, and how and to what extent these narrations were reflected in the views of the Islamic sects. In this respect, we believe that the study has a unique content and will contribute to filling the gap in this regard. In the study, we presented the mentioned narrations first, and then included interpretations of Hazrat Aisha on these narrations, and mentioned the views of the Islamic sects in the context of these narrations right afterwards, and finally, revealed the influence of the above-mentioned narrations on the formation of the Islamic sects' views regarding women's jurisprudence (fiqh). It is realized that the narrations from Hazrat Aisha are the source of women's jurisprudence, and that they clear away the negative perception towards women, allow many issues to be explained, and that there will be incompleteness in the judgements if the narrations have not reached up to us.
