Private Security Profession, Duties and Authorities in Turkey as a Complementary Element of Public Security
Abstract
Geçmişten günümüze güvenlik her zaman insan için önemli bir yere sahip olmuştur. Değişen ve gelişen çağımızda neredeyse her alanda güvenlik temelli kaygıların var olduğu bilinen bir gerçektir. Güvenlik temeli kaygılar ile birlikte güvenliği sağlamada görevli birimlerde bu değişim ve gelişimden etkilenmiştir. Geniş bir alanda kamu güvenliğini sağlamanın zorluğu ve duyulan ihtiyaç çerçevesinde dünyanın birçok ülkesinde ve Türkiye'de güvenlik hizmetlerinin sağlanması adına özel güvenlik hizmetlerine ihtiyaç duyulmaktadır. Türkiye'de iç güvenliği sağlamakla görevli genel kolluğun yanında kamu güvenliğini tamamlayıcı bir unsur olarak özel güvenlik hizmetleri de faaliyet göstermektedir. Özel güvenlik hizmetleri, özel güvenlik görevlileri aracılığıyla yerine getirilir. Gerek önleyici kolluk hizmetleri gerek adli kolluk hizmetleri kapsamında görev yapmakta olan özel güvenlik görevlilerinin, başta kamu güvenliği olmak üzere, bireysel güvenlik ve toplumsal güvenliğe önemli katkıları vardır. Bu çalışma ile Türkiye'de özel güvenlik görevlilerinin görev ve yetkilerinin incelenmesi ve bu kapsamda mevzuat çerçevesinde uygulamada ortaya çıkabilecek boşluklarla ilgili değerlendirmelerin yapılması amaçlanmıştır. Çalışmada, özel güvenlik alanında mevzuatta hukuki boşlukların bulunduğu ve yeni hukuki düzenlemelere ihtiyaç duyulduğu sonucuna varılmıştır.
From past to present, security has always had an important place for people. It is a known fact that there are security-based concerns in almost every field in our changing and evolving age. Along with the security fundamental concerns, the units responsible for providing security have been affected by this change and development. Private security services are needed to provide security services in many countries of the world and in Turkey within the scope of the difficulty and need to ensure public security in a wide area. In addition to the general law enforcement, which is responsible for providing internal security in Turkey, private security services also operate as a complementary element to public security. Private security services are provided by private security guards. Private security officers, who work within the scope of both preventive law enforcement services and judicial law enforcement services, have serious contributions to public security, individual security as well as social security. With this study, it is aimed to examine the duties and authorities of private security officers in Turkey and to make evaluations about the gaps that may arise in practice within the framework of the legislation. In the study, it was concluded that there are legal gaps in the legislation in the field of private security and that new legal regulations are needed
