The Conception of Suspicion and Its Effect on the Punishment in Islamic Punitive Lav

Abstract

?İslâm Ceza Hukukunda Şüphe Kavramı ve Cezalara Etkisi? adlı tez çalışmamızda, İslâm Hukukunda şüphenin cezaları düşürmedeki etkisi incelenmiştir. Bu çerçevede çalışmamız bir giriş üç bölüm olmak üzere dört bölümden oluşmuştur:Giriş bölümünde, İslâm Ceza Hukukunun iki temel kavramı olan suç ve ceza kavramları kısaca anlatılmıştır. İkinci bölümde ise, şüphe kavramının tanımı, şüphe benzeri kavramlar, suç fiillerini ispattaki etkisi genel hatlarıyla anlatılmıştır. Ayrıca bu bölümde suçun unsurları ile şüphe kavramının suçun unsurları arasındaki yeri de anlatılmıştır.Üçüncü bölümde; şüphenin mahiyeti, çeşitleri, bunların kendi arasındaki kısımları, mezheplerin görüş farklılıkları da göz önünde bulundurularak örneklerle anlatılmıştır.Dördüncü bölümde ise; özel ceza hükümleri açısından şüphenin cezaya etkisi; özellikle hadd, kısas, müessir fiiller ve ta'zir cezalarını gerektiren suçları ele alarak konunun mahiyetini anlatır bir şekilde örnekler verilerek anlatılmıştır.Sonuç olarak, çalışmamızda Medeni Hukukta ?Şüpheden sanık faydalanır? şeklinde ifade edilen prensibin, İslâm Ceza Hukuku'nda da ?Cezaları şüphelerle kaldırınız? temel prensibiyle gündeme gelen temel kaidenin, İslâm Ceza Hukuku'nda özellikle telafisi mümkün olmayan, hadd ve kısas gibi cezaların düşürülmesinde ne kadar önemli ve etkili olduğu gerçeği dile getirilmeye çalışılmıştır.

In the study ?The conception of suspicion and its effect on the punishment in İslâmic Punitive Law? the effects of suspicion on decrecsing the punishments in İslâmic Law are analized in that frame, the study consists four parts.İn the introduction port, the notions ?crime and punishment? which are the main conseptions of İslâmic punitive law are briefly explained. İn the second part the definition of ?suspicion?, its related conceptions, its effects on proving of crime actions are largely explained. Moreover, in this part components of crime and the place of ?suspicion? among those components are also introducot.Then in next part, the nature and types of suspicion and also their subdivisions are told with axsamdes. İn this procoss divergences of religiovs sects are taken into account.İn the last part, the effect of suspicion on punishment in respect of spesial punishment commands is explained with examles. By doing this the crimes which regvire especially haad, retaliation, assault and battery and ta?zir punishments are analized.This main principle, the suspicion, is mentioned as ?Suspect benefits suspicion? in Civil Law. İn İslâmic Punitive Law it is expressed as ?abolish the punishments by suspicions?. İn this study, consecvently, the importance and effect of this truth on reducing the uncompensatable punishments such as hadd and retaliation are tried to be explained.
