The End of Foundation Leggality in Foundation Properties Accorddng To Islamic Law

Abstract

?İslâm Hukukuna Göre Vakıf Mallarında Vakıf Hükmünün Sona Ermesi? isimli tezimiz bir giriş ile üç bölümden meydana gelmektedir. Giriş bölümü araştırmanın amacı, önemi, sınırları ve yönteminden oluşmaktadır.Birinci bölümde Hanefî, Maliki, Şafiî ve Hanbelîlere göre, vakfın kavramı işlenmiştir. Vakfın rükün ve şartlarıyla ilgili mezhep âlimlerin ilgili görüşleri araştırılmıştır.İkinci bölümde; dört Mezhep ve Osmanlı uygulamasında, sahih olarak kurulan bir vakıf muamelesinin ne gibi sonuçlar doğuracağı tespit edilmeye çalışılmıştır. Vakfın hükmü başlığı altında vakıf hükmünün doğurduğu sonuçlardan vakfın bağlayıcılığı (lüzümu), süresiz (te'bid) olması vakıftan vazgeçilmesi (rücû), vakfedilen malın mülkiyeti, irsâdi vakıflar ve para vakıfları gibi konular incelenmiştir.Üçüncü bölümde ise; dört Mezhep ve Osmanlı uygulamasında uygulamada güncel problemlerle karşılaşılan vakıf mallarında vakıf hükmünün sona ermesiyle ilgili fakîhlerin görüşleri, mukayese edilecek bir şekilde değerlendirmeye tabi tutulmuştur. Ayrıca vakıf mallarında vakıf hükmünün sona ermesine sebep olan vakıftan yararlananların kalmaması (inkita'ı) ve yararlanma imkânı kalmayan (müstağna ânh) vakıfların durumuna çözüm bulmak için vakfın değiştirilmesi (istibdâl edilmesi) konusu ve hizmet etme imkânı kalmamış vakıf mallarının durumunu incelenerek ve tespit edilerek konu bitirilmiştir.

Our thesis named ?The end of Foundation Legality in Foundation Properties according to Islamıc Law? is composed of three parts with the introduction. The introduction includes the aim, importance, limits and method of the research.In the first part, the concept of Foundation according to Hannafî, Maliki, Shafii and Hanbelis was examined. The views of scholars from different sects with regard to the principles and rules of Foundation were researched.In the second part, what kind of results an authentic Foundation could arise was examined. Under the title of Foundation concept, the essentiality of Foundation, being indefinite (te'bid), renunciation from Foundation (rücû), ownership of donated property, ?irsâdi Foundations? and monetary Foundations were examined.In the third part, the views of the canonists with regard to the problems concerning the end of Foundation legality in Foundation properties in four sects and Ottoman applications were comparatively evaluated. Furthermore, that there is no one to benefit from Foundation properties and this causes the end of vakf hüküm, (inkita) the change of useless Foundations (müstağna ânh) to find a solution for this and the examination of old Foundation properties were also evaluated.
