Abstract
?İslâm Hukukunda Delil Olma Yönüyle Örf ve Âdet? isimli tezimiz bir giriş ile üç bölümden meydana gelmektedir. Giriş bölümü araştırmanın amacı, yöntemi ve sınırlarından oluşmaktadır.Birinci bölümde İslâm hukukunda delil kavramı üzerinde durup asli deliller ile fer'i delilleri kısaca açıklamaya çalıştık.İkinci bölümde örf ve adet kelimelerinin anlamlarını verdikten sonra bu delilin kısımlarından bahsettik.Üçüncü bölümde ise örfün hüccet oluşuna Kur'an ve Sünnetten delilleri sıraladıktan sonra örf ve âdetin hüccet değeri kazanması için aranan şartları sıraladık. Ayrıca, hulefa-i raşidin kararlarında örfün etkisi ve mezheplerin örf ve âdet deliline bakışı ele alındı. Örfün değişmesiyle, örfe bağlı hükümlerinde değişmesi, hüküm veren kişilerin içinde yaşadıkları toplumun örf ve âdetlerini dikkate almaları gerektiğine de değindik.Anahtar kelimeler; örf, âdet, delil, İslâm hukuku, fukâha.
The thesis on ?Customs and Traditions as Evidence in Islamic Law? is composed of preface and three parts. Borders, methods, importance and objective of the researcher are included in the preface.Mentioning about the concept of evidence in Islamic Law, we have shortly explained the basic and secondary evidences in Part I.In Part II, we have explained the types of evidence after defining the concepts of custom and traditionIn addition to giving examples to customs as evidence from Qur?an and the Sunnah, we have described the conditions which are obligatory for the customs and traditions to be considered as evidence in Part III. We have also explained the effects of customs on the decisions of the four caliphs and the views of denominations on the evidential customs and traditions.
