Law Enforcement Services and Basic Problems and Solution Proposals Encountered in the Presentation of the Uniformed Services in Turkey

Abstract

Kolluk, toplumun genel düzenin sağlanmasında yerine getirilmesi gereken en önemli kamu hizmetlerinden birisidir. Kamu güvenliği, kamu sağlığı, kamu refahı ve modern anlayışta kamu estetiğini ifade eden kolluk hizmeti farklı idari birimlere bağlı teşkilatlar tarafından yerine getirilmektedir. Mevzuatta yetkili birimler her ne kadar açık bir şekilde ifade edilmiş olsa da uygulamada kolluk birimlerinin bu hizmeti yerine getirmede karşılaşmış oldukları ciddi sorunlar bulunmaktadır. Türkiye' de zaman zaman merkezi kolluk birimleri, merkez yerel kolluk birimleri ya da genel ve özel kolluk birimleri arasında görev ve yetki sorunu kaçınılmaz olarak karşımıza çıkmaktadır. Bu sorunun temelinde hem kolluk hizmetlerinin teşkilatlanması hem de kolluk hizmetinin iç içe olmasının büyük etkisi vardır. Bu çalışmada Türkiye'de genel olarak kolluk hizmeti üzerinde durulmuş, kolluk hizmetinin yerine getirilmesinde karşılaşılan görev ve yetki sorunları ortaya çıkarılmaya çalışılmıştır. Akabinde de bu sorunların ortadan kaldırılması için ne gibi çözümlerin olacağı üzerinde durulmuştur.

The law enforcement is one of the most important public services that must be fulfilled in the provision of the general order of the society. Law enforcement that expresses public aesthetics in public security, public health, public welfare and modern understanding is carried out by organizations affiliated to different administrative units. Although the authorized units in the legislation are clearly expressed, there are serious problems that law enforcement units have faced in performing this service. From time to time in Turkey, the problem of duty and authority between the central law enforcement units, central local law enforcement units or general and private law enforcement units are inevitably encountered. In the emergence of this problem, both the organization of law enforcement services and the intertwined of the law enforcement has a great effect. In this study, it was tried to reveal the task and authority problems encountered in the fulfilment of law enforcement officers in general in Turkey. Subsequently, it is emphasized what solutions will be to eliminate these problems.
