Abstract

?İslâm Hukukunda Sarhoşluğun Ceza Ehliyetine Etkisi? başlıklı tezimiz, Önsöz, üç bölüm, Sonuç ve Kaynakça kısımlarından oluşmaktadır. Önsözde çalışmanın amacı belirtilerek, tezde işlenen konuların genel değerlendirilmesi yapılmıştır. Birinci Bölüm'de Suç ve Ceza Kavramları, Cezanın Amacı ve Suçun Unsurlarına yer verilmiştir. İkinci Bölümde Sarhoşluğun Tanımı, Sarhoşluk Veren Maddeler, Sarhoşluk Veren Maddelerin Dini Hükmü ve Ehliyet Kavramı'na değinildikten sonra Sarhoşluğun Ceza Ehliyetine Etkisi Nazariyesi ele alınmıştır. Üçüncü Bölümde Kısas ve Diyet Suçlarında Sarhoşluğun Ceza Ehliyetine Etkisi ve Had Cezaları Açısından Sarhoşluğun Ceza Ehliyetine Etkisi değerlendirildikten sonra Had Suçlarının Özellikleri ve Çeşitleri incelenmiştir. The work titled ?The Effect Of Drunkenness On cukpability In Islamic Law? is composed of parts as preface, three chapters, conclusion and bibliography. In the preface, aim of the work is explained and general evaluations of the subjects searched in the work are given. In the first chapter, concepts of crime and punishment, purpose of punishment and elements of crime are evaluated. In the second chapter, after giving description of drunkenness, intoxicant products, religious decision on intoxicant products and criminal discretion concept, The Theory of Impact of Drunkenness to Criminal Discretion is evaluated. In the third chapter, after evaluating impacts of drunkenness to criminal discretion in retaliation and blood money crimes and in had crimes, peculiarities and kinds of had crimes are examined. In the conclusion, a general evaluation of detailed chapters and our thoughts are given. Key words: Islamic Law, Drunkenness, Criminal Discretion.
