Abstract

Bu Çalışma H.1247-1253/M.1831-1837 yılları arasını ihtiva eden 285 Numaralı Tarsus Şer'iyye Sicili'nin incelenmesinden oluşmaktadır. 285 Numaralı Tarsus Şer'iyye Sicili Osmanlıca metninin günümüz Türkçesine çevrilmesinde metne sadık kalındı, kelimeler değiştirilmeksizin cümle kuruluşları aynı şekilde verildi. Ana metin basit transkribe tekniği ile okundu. Metinde geçen Farsça, Arapça, Türkçe sıfat ve tamlamalar bu dillerin gramer kurallarına göre yazıldı. Osmanlıca metinde geçen, ayın harfi: (') işareti, hemze (elif) harfi: (') işareti, uzun a: â harfi, uzun i: î harfi, uzun u: û harfi ile yazıldı. Sicilde geçen 116 belgenin tamamının transkripsiyonu yapılarak değerlendirildi. Belgede yer alan hükümlerin özeti tablo halinde verildi. Çalışmamızın özet tablosu, defter hakkındaki bütün sorulara cevap verebilecek niteliktedir. Sicilde; verâset, vesâyet, mihir-boşanma, tereke taksimleri gibi konular yer almaktadır. Şer'iyye sicilleri kaydedildiği dönem hakkındaki en orijinal bilgileri içermektedir. Bu bilgiler ışığında dönemin sosyal, idarî, hukukî, iktisadî ve kültürel yapısı hakkında bilgilere ulaşmak mümkündür. Bu amaç doğrultusunda sicilde yer alan yer isimleri, devlet görevlilerinin isimleri, askerî görevlilerin isimleri birer birer tespit edildi. Yine sicilde geçen camii, medrese ve diğer dinî yapıların birer birer tespiti yapıldı. Sicilde dönemin soysal yapısı hakkında bilgiler verildi. Dönemin giyim-kuşamı ve kullanılan eşyaların tespiti yapıldı. Yine dönemin iktisadî yapısı hakkında genel bilgiler verilip meslek grupları, çarşıları, dükkânları, esnaf grupları, iskeleleri tespit edildi. Ayrıca dönemin eşya fiyatları ve hayvan fiyatlarına ulaşıldı.

This study consists of the examination of the Islamic law register, number 285 belonging to Tarsus which occured between the year –1247 and 1253 (of Islamic calendar)–1831 and 1837 (of Gregorian calendar) While translating the register from the Ottoman Turkish into modern Turkish, was remained faithful to the text, giving the words and the structures of the sentences as the same. The adjectives and phrases that used in Persian, Arabic, and Turkish were written according to their grammar rules. The source text was read by the simple transcription tecnique. Some letters that occur in the Ottoman Turkish were adapted like the following: ayın ( ع) : ('), elif : ('), long a: â, long i: î, long u: u. All of the 116 documents in the register were translated and evaluated. The summaries of the verdicts in the text were given in the form of table. The table of the summary in the study is capable of answering all the questions concerned with lawsuit. The essential topics of the register consist of inheritence, guardianship, divorce, the appointments of the trustees, theft, and soon. As it is known, the Islamic law registers contain the most original information about the period in which they were produced. In the light of this information, it is possible to reach the information about the social, administrative, judicial, economic, and cultural structures. Considering this purpose, the names of locations, administrators, military officiers, imams, village headmen, and priests, in the text were ascertained one by one. The names of the mosques, Moslem theological schools, and other religious contitutions in the text were also indicated one by one. The study has information about the social structure of the time, taken from the register. The people's apparel and things that used by them were indicated. In addition, giving a general information about the economic structure of the period, occupations, markets, and shops were ascertained. The prices of goods and animals of the time were obtained.
