The Effect of Color, Smell, Taste and Sounds on Judgments in Fiqh
Abstract
Bu çalışmamızın amacı varlıkları birbirinden ayırmak ve var olanları anlamlandırmak için yaratılmış olan temel unsurların başında gelen renk, koku, tat ve sesleri incelemektir. İnceleme konusu salt olarak renk, koku, tat ve seslerin kendileri olmayıp bunların klasik veya modern dönemde var olan şer'î hükümlerde olumlu ya da olumsuz yönden meydana getirdikleri etkileri olacaktır. Kimi zaman bu unsurlar farz olan ibadetlerde olması elzem olan bir şartken, bazen de yapılan bir satışta var olan muhayyerlik hakkını elde etmeyi sağlayan bir alâmet, bazen de işlenen bir suçun ispatında delil olabilmektedir. Araştırmaya konu olan renk, koku, tat ve ses unsurlarının tümü İslâm hukukunda var olan ibâdât, muâmelât ve ukûbât ekseninde dört mezhebe göre incelenmiştir. Her bir unsur müstakil birer bölüm olarak ele alınmış olup her bölümde de söz konusu unsurların ilgili alanlardaki hükümlere tesirinin bulunup bulunmadığı, hükümlerde meydana getirmiş oldukları olumlu veya olumsuz etkilerinin olup olmadığı incelenmeye çalışılmıştır. The aim of this study is to examine colors, smells, tastes and sounds, which are the basic elements created to distinguish beings from each other and to give meaning to existing things. The subject of examination will not only be the colors, smells, tastes and sounds themselves, but the positive or negative effects they have on the religious rules existing in the classical or modern periods. Sometimes these elements are an essential condition for mandatory worship, sometimes they can be a sign that enables the right of choice in a sale, and sometimes they can be evidence in proving a crime committed. All the elements of color, smell, taste and sound, which are the subject of the research, were examined according to four sects on the axis of worship, muâmelât and ukûbât existing in Islamic law. Each element has been considered as an independent section, and in each section, an attempt has been made to examine whether the elements in question have an impact on the provisions in the relevant fields and whether they have positive or negative effects on the provisions.
