The Transformation of Classic Sovereignty Approach: an Evaluation Upon the European Union

Abstract

Egemenlik kavramı gerek pratikte yaşananlarla ve gerekse kuramsal altyapısının oluşumu sürecinde teorik olarak uzun zamanlardan beri devamlı olarak tartışılan bir kavram olarak, sosyal bilimlerin pek çok disiplininde ve uluslararası sistemin hemen her aşamasında ön plana çıkmıştır. Klâsik egemenlik teorileri ve yaklaşımlarına göre egemenlik mutlak, en üstün, bölünmez ve devredilemez bir yapıya sahiptir. Ancak, çağdaş anlamda egemenlik kavramına bakıldığında, devletin egemenlik anlayışının teorik olarak değerini koruduğu ama pek çok hukukî ve fiili sınırlamalara uğrayarak klâsik anlamından uzaklaşıp mutlak, bölünmez ve en üstün olma özelliklerini yitirdiği görülmektedir. Bu dönüşüm kapsamında çalışmamızda, diğer uluslararası ve uluslarüstü örgütlenmelerden farklılık gösteren Avrupa Birliği incelenerek devlet egemenliğine müdahalesinin nasıl değerlendirilebileceği ve üye devletlerin egemenliklerini hangi boyutlarda etkilediği sorgulanacaktır.

The concept of sovereignty has come to the forefront in many disciplines of social sciences and in almost every stage of the international system, as a concept that has been discussed continuously both theoretically and in the process of its theoretical infrastructure. According to classical sovereignty theories and approaches, sovereignty has an absolute, supreme, indivisible and non-transferable structure. However, if the concept of sovereignty is assessed in the contemporary sense, it can be observed that the state's understanding of sovereignty preserves its value theoretically, but it has lost its absolute, indivisible and superior features by being subject to many legal, actual and international limitations. In this study, we will examine the European Union, which differs from other supranational organizations, by examining how its intervention in state sovereignty can be assessed and to what extent it affects the sovereignty of member states.
