An Inquiry on Law in Thomas Hobbes

Abstract

Thomas Hobbes, modern siyaset felsefesinin önde gelen filozoflarından biridir. Onun bütünlüklü felsefesi, yaratmış olduğu kavramlarla daha açık ve anlaşılır hale gelmiştir. Siyaset felsefesinde sıklıkla kullanılan kavram ya da kavramlaştırmalar da Thomas Hobbes'un felsefesinde böylelikle yeniden anlamını bulmuştur. Klasik öğretilerin çok uzağında kalan Thomas Hobbes'un felsefesi doğa-yasa ilişkisine dayanmaktadır. Bundan dolayı Thomas Hobbes'un siyaset felsefesindeki ilk hareket noktası doğa durumu anlatısıdır. Hobbes, doğa durumu anlatısından doğa yasası ve toplum sözleşmesi kavramlaştırmalarına ulaşmıştır. Doğa durumu anlatısının siyaset felsefesinde hareket noktasını oluşturmasının temel sebebi de insanın en temel ihtiyacı olan güvenlik ihtiyacını en iyi açıklayan anlatı olmasıdır. Güvenlik ihtiyacı, korkunun tetiklediği bir ihtiyaç olduğundan insan, doğa yasasından yola çıkarak toplum sözleşmesini gerçekleştirmiş ve devleti yaratmıştır. Devlet de böylelikle toplum düzeninin getirmiş olduğu barışın en büyük temsilcisi ve koruyucusu konumuna yükselerek, toplumsal güvenlik ve barış ilişkisinin en önemli unsuru haline gelmiştir. Olgusal olanın üzerinde teolojik ve metafizik bir olması gereken olarak konumlanan yasa, Hobbes ile birlikte radikal bir dönüşüme uğramıştır. Hobbes'un kurguladığı yasa, devlet ve egemen özdeşliği yasanın geleneksel kökenlerinden kopuşuna olanak sağlamıştır. Yasa ile ilgili bu kırılma Batı siyasal teorisinde önemli bir dönüm noktasıdır. Bu çalışmanın temel amacı Thomas Hobbes'un yasa üzerine düşüncelerini siyasal ve hukuksal bağlamda ele almaktır.

Thomas Hobbes is one of the foremost philosophers of modern political philosophy. His integrated philosophy has become more clear and understandable with the concepts he has created. The concepts or conceptualizations that are frequently used in political philosophy have thus found their meaning in Thomas Hobbes' philosophy. Thomas Hobbes's philosophy is based on the relationship between nature and law. Thus Thomas Hobbes's first starting point in political philosophy is the narrative of the state of nature with which Hobbes reached the conceptions of the law of nature and the convention of society. The main reason for this is that it is the narrative that best describes the security need. Since the need for security is a need triggered by fear, human beings have realized the social contract based on the law of nature and created the state. Thus, the state became the most important representative and protector of the peace brought about by the social order and became an important element of the relationship between social security and peace. The law, which is positioned as theological and metaphysical on the factual, has undergone a radical transformation with Hobbes. The law, state and sovereign identity identified by Hobbes allowed the law to break away from its traditional origins. This break with the law is an important turning point in Western political theory. The purpose of this study is to examine Thomas Hobbes' thoughts on the law in the political and legal context.
