Evaluation of the Perceptions of the Muhktars Working Within the Borders of Erciş and Gevaş District Municipalities on the Effects of the Law Number 6360 on the Rural Areas

Abstract

2012 yılında kabul edilen 6360 sayılı Kanun ile 16 olan büyükşehir belediye sayısı, Van ilinin de aralarında bulunduğu 14 ilin eklenmesiyle 30'a yükselmiştir. Kaliteli, etkin ve verimli hizmet sunmak gerekçesiyle çıkarılan 6360 sayılı Kanun, büyükşehir belediye sisteminde yönetsel, hukuki, finansal ve siyasal açıdan köklü değişiklikler meydana getirmiştir. 6360 sayılı Kanun sonrası büyükşehir statüsündeki tüm kentlerde büyükşehir belediyelerinin hizmet sorumluluk alanları il mülki sınırlarına kadar genişletilmiş ve il özel idareleri ve bucak yönetimleri kapatılmıştır. Ayrıca 6360 sayılı Kanunun getirdiği değişikliklerle büyükşehir statüsüne giren illerde köy yönetimleri ve belde belediyelerinin tüzel kişilikleri kaldırılmış ve en yakın oldukları ilçelere bağlı mahallelere dönüştürülmüştür. 6360 sayılı Kanun ile mahalleye dönüşen köyler hem büyükşehir belediyesinin hem de bağlı bulundukları büyükşehir ilçe belediyelerinin hizmet alanı içerisine girmiştir. Bu doğrultuda çalışmanın temel amacı, Erciş ve Gevaş ilçe sınırları içerisinde kapatılan ve mahalleye dönüştürülen köylerde görev yapan mahalle muhtarlarının 6360 sayılı Kanun sonrası kamusal hizmetlerin yerine getirilmesi konusunda meydana gelen olumlu veya olumsuz değişikliklere dair görüşlerini araştırmak ve değerlendirmektir. Çalışmada Erciş ve Gevaş ilçelerinde görev yapan 86 eski köy/yeni mahalle muhtarıyla yüz yüze veya telefon yoluyla görüşme gerçekleştirilmiş ve anket tekniğinden yararlanılmıştır. Toplanan veriler SPSS 20.0 programında analiz edilmiştir. Çalışma sonucunda Erciş ve Gevaş ilçelerinde görev yapan mahalle muhtarlarının 6360 sayılı Kanun sonrası oluşan büyükşehir belediye sistemi içerisinde gerek büyükşehir belediyesi gerekse ilçe belediyesi tarafından sunulan hizmetlerde bir iyileşme görmedikleri ve mahallelere sunulan hizmetlerde geçen 7 yıllık süreye rağmen hala aksamaların olduğu tespit edilmiştir. Ayrıca mahalle muhtarlarının yetkilerinde yaşanmış olan azalmadan dolayı ihtiyaç duyulan tüm konularda ilçe belediyesine bağımlı hale gelmeleri nedeniyle ilgili kanun sonrası sistemi olumsuz karşıladıkları saptanmıştır.

The number of metropolitan municipalities, which was 16 with law number 6360, adopted in 2012, increased to 30 with the addition of 14 provinces including The city Van. The law number 6360, issued on the grounds of providing quality, effective, and efficient services, has led to radical changes in the metropolitan municipality system from an administrative, legal, financial, and political point of view. After the law number 6360, the service areas of responsibility of the metropolitan municipalities in all cities with metropolitan status were extended up to the provincial administrative boundaries and special provincial administrations and sub-district administrations were closed. Moreover, with the changes introduced by the law number 6360, the legal entities of village administrations and town municipalities in the provinces that have become metropolitan cities were abolished and they were converted into neighborhoods connected to the districts which they are closest to. With the law number 6360, the villages that became neighborhoods were included in the service area of both the metropolitan municipality and the metropolitan district municipalities to which they are affiliated. In this direction, the main purpose of the study is to research and evaluate the opinions of the mukhtars working in the villages transformed into neighborhoods within the boundaries of Erciş and Gevaş districts regarding the positive or negative changes that occurred in the fulfillment of public services after the law number 6360 came into force. In the study, face-to-face or telephone interviews were conducted with 86 former village/new neighborhood mukhtars working in Erciş and Gevaş districts, and a questionnaire technique was applied. The collected data were analyzed using SPSS 20.0 program. As a result of the study, it was found that the neighborhood mukhtars working in both Erciş and Gevaş districts did not notice any significant improvement in the services provided by either the metropolitan municipality or the district municipality within the metropolitan municipality system formed after the law number 6360 and that there are still disruptions in the services provided to the neighborhoods despite the period of 7 years. It was further observed that it was determined that the Mukhtars have become dependent on the district municipality for all their needs due to the decline in their powers and, therefore, take a poor view of the system under the relevant law.
