Casualties of Right Wich Non- Offical Marriage Caused Practices in Respect of Islamic Law

Abstract

Bu çalışma, ana hatlarıyla iki nokta üzerinde yoğunlaşmaktadır.Birincisi İslam'da aile kurumun oluşmasında ilk adım olan nikâh ve evliliktir.Bütün hukuk sistemlerinde bu yer almakla beraber İslam hukukunda nikâhhukuki bir akit olmaktan öte kutsal bir yapıya bürünmüştür.Aile insanoğlunun içinde doğup büyüdüğü, ilk eğitimini aldığı en küçüksosyal yapıdır. Toplumun çekirdeğini oluşturur. Toplumun yapıtaşı olan bukurum içerisinde kadın ise son derece önemli bir yere sahiptir. Çünkütoplumu doğuran ve yoğuran kişidir.Tarih içerisinde evliliklere baktığımızda ise kadının durumu ve konumubize aile kurumu hakkında yeterli bilgiyi vermektedir. Bu açıdan bakıldığındaİslam'ın aile müessesesine ve kadına verdiği değer kendiliğinden ortayaçıkmaktadır. Çünkü İslam'ın hedefi insanlara hem dünyada hem de ahirettemutluluk vermektir. Nikâh konusu da tamamen kadının haksızlığauğramaması üzerine kuruludur.Fakat İslam'ın bu hassasiyetinin yanlış anlaşılıp, yanlış uygulanması,günümüzde insanlara bazı sıkıntılar yaşatmaktadır. Bir diğer nokta olarak elealdığımız bu durum ? Resmi ve medeni nikâh formları? başlığıyla, yaşananörneklerle ortaya konulmuştur.

This study with its main lines dwells upon two points.The first one ismarriage and marriage ceremony which is the first step in constituting familystructure in Islam.Apart from being a treaty,in Islamic law marriageceremony has a holy structure.Family is the smallest social structure in which human beingborn,grow and take his first education.It consists the stone of society.In thisinstitution which is the main part of society,women has considerablyimportant place.Because she is the person giving birth and treating society.In history,when we look at marriages,the situation and position ofwomen give us adequate knowledge about family institution.So,when lookedfrom this side, the value Islam gave to women and family institution naturallyarises.Because primary target of Islam is give happiness to people both inworld and Ahret. Marriage ceremony conception is wholly built on notmeeting women with unjusticeness.But Today, misunderstanding and implementing this sensitiveness ofIslam has caused some problems to people.This situation that we take intoconsidiration as another point,has been indicated by living examples with thetitle of 'Formal and civilized marriage ceremony forms'.
