Debate on the Goverment System in Turkey Anda the Presidential Goverment System

Abstract

Türkiye'de son elli yıldır hükümet sistemlerini konu edinen çeşitli tartışmalar yaşanmaktadır. Parlamenter sistem kaynaklı çeşitli sorunların ortaya çıktığı dönemlerde bu tartışmaların daha çok yapılmıştır. 2018 yılından önceki tartışmalara bakıldığında bu tartışmaların daha çok siyasal zeminde yapıldığı ve yeterince akademik bir bakış açısı ile değerlendirilmemiştir. 16 Nisan 2017 tarihinde yapılan referandum ile Türkiye'de parlamenter sisteme son verilmiş ve Cumhurbaşkanlığı hükümet sistemine geçilmiştir. Bu tez çalışmasında, Türkiye'de yeni hükümet sistemine neden ihtiyaç duyulduğu, yeni sisteme geçişte gerçekleşen tartışmaların değerlendirilmesi ve Cumhurbaşkanlığı hükümet sisteminin detaylı incelemesinin yapılması amaçlanmıştır. Bu çalışmada, hükümet sistemleri her yönüyle incelenmiş ve sınıflandırılmıştır. Parlamenter, başkanlık ve yarı başkanlık hükümet sistemleri avantaj ve dezavantajlarıyla birlikte değerlendirilmiştir. Tarihsel süreç içinde, Türkiye anayasalarında uygulanan hükümet sistemleri ele alınmış, Cumhurbaşkanlığı hükümet sistemi detaylı bir şekilde analiz edilmiş, olumlu ve olumsuz tarafları açıklanmaya, başkanlık ve parlamenter sistem arasındaki farklılıklar belirtilmeye çalışılmıştır.

There have been various debates on government systems in Turkey for the last fifty years. During the periods when various problems originating from the parliamentary system arose, these discussions were made more often. Looking at the debates before 2018, these debates were mostly held on political grounds and were not evaluated from an academic point of view enough. With the referendum held on April 16, 2017, the parliamentary system was ended in Turkey and the Presidential government system was introduced. In this thesis, it is aimed to evaluate why the new government system is needed in Turkey, to evaluate the discussions that took place during the transition to the new system, and to make a detailed examination of the presidential government system. In this study, government systems are examined and classified in every aspect. Parliamentary, presidential and semi-presidential government systems are evaluated together with their advantages and disadvantages. In the historical process, the government systems implemented in the Turkish constitutions have been discussed, the presidential government system has been analyzed in detail, the positive and negative sides have been explained, and the differences between the presidential and parliamentary systems have been tried to be stated.
