Abstract
Bu çalışmamızda mezhepler arasındaki temel prensip ve deliller ele alınarak deniz hayvanlarının tüketilmesinin helâl, haram ve mekruh olarak hükümlendirilmesinin incelenmesi amaçlanmıştır. Çalışmamız bir giriş ve üç bölümden müteşekkildir. Girişte konunun kapsamı, amacı ve yöntemi ele alınmıştır. Birinci bölümde, tüketilmesine helâl hükmü verilen deniz hayvanlarının tayyib, tüketilmesine haram hükmü verilen deniz hayvanlarının habîs olarak değerlendirilmesi sebebiyle tayyib ve habîs kavramları izah edilmeye çalışılmıştır. Daha sonrasında helâl, haram, mekruh ve hût kavramları genel olarak açıklanmıştır. İkinci bölümde, hayvanların hükmü belirlenmeye çalışılırken esas alınan ilke ve yöntemler, mezhepler arasındaki algılayış farklılıkları dikkate alınarak izah edilmeye gayret edilmiştir. Üçüncü bölümde, Ehl-i sünnet olarak isimlendirilen mezheplerin temel kaynaklarında deniz hayvanlarının tüketilmesine verdikleri hükümler, bu hükümlere ulaşırken kullanmış oldukları deliller ve mezhep içerisindeki farklı görüşler ele alınmış, gerekli görülen yerlerde değerlendirmelere yer verilmiştir.
In our this study, the resparch of canswing sea animals in the aspect of halal, illicit and mushbooh hondling sectoriun proofs and criterions has been aimed. Our study consist of three ports which are introduction, budy and conclusion In the first port, the content, the aim and the method of plot have been hondlend. In the first port, these two concepts whic are permissible and mallignant have been generally tried to be expluined because consuming sea animals whic are regurded as permissible are named tayyeb and ronsuming the other ones whic aren't regarded as permissible are named malignant. Consuming a food is generally evaluated as illieit, mushbooh or halal. In the secont port; when it is tried to be determined the provision of animals, the principles and the methods which are based on have been endeavared to be explained within the frame of sectarian perception. In the third purt, in the primary sources of sects which are followers of sunnah, their provisions adjudged by them for consuming sea animals, the proofs used by them when coming up with these provisions, different perceptions in the sect have been handled and evaluations, when it is needed, have been ranked.
